1.双方约定机械由方负责操作与维护。本合同约定的操作维护方应当按照机械运营、操作规定配备符合国家或地方法律法规规定上岗条件的操作、指挥、维护等人员，也可委托具备相应资质的专业公司承担机械的操作与维护，受托方行为视为该委托方行为。

1.Thepartiesagreethatthepartyshall,inaccordancewiththeregulationsofthemachinery’soperationandoperation,beresponsiblefortheoperationandmaintenanceofthemachinery.Thepartyforoperatingandmaintenance,asspecifiedinthiscontract,shallbestaffedwiththepersonnelofoperation,commandandmaintenancewhichconformingtothestateorlocallawsandregulations,ormayentrusttheoperationandmaintenanceofthemachinerytotheprofessionalcompanieswithcorrespondingqualifications,andtheactoftheentrustedpartyshallbedeemedastheactofsuchentrustingparty.

2.因故障造成机械无法正常作业的，乙方应当自接到通知时起小时内到达现场维修。乙方自接到维修通知起小时/日内未能修复的，自第日起免收租金直至机械恢复正常作业日止。但机械故障系因甲方违章指挥、违章作业造成的，甲方仍应支付停工期间的租金。

2.Wherefailureofthemachine’snormaloperationduetoitsfault,PartyBshall,uponreceiptofnotice,beatthesiteforrepairwithinhours.Wherethemachineisnotrepairedwithinhours/days,therentalfeewill,fromthedateofreceiptoftherepairnotice,untilthemachineresumesnormaloperation.However,ifthemachinerybreakdowniscausedbyPartyA'sviolationofrulesandregulations,PartyAshallstilleffectpaymentoftherentfortheperiodofsuspension.

甲方权利义务RightsandobligationsofPartyA

1.甲方有权要求乙方按照合同约定提供合格的机械。

2.甲方有权要求乙方按照合同约定提供机械的维修保养服务。若因乙方原因导致机械毁损、灭失或者出现故障无法使用的，甲方有权解除合同或要求乙方更换同等型号、性能的机械，并要求乙方赔偿损失。

3.甲方应当按照合同约定的时间、方式和金额支付租金和其他费用。

4.甲方应当为乙方提供机械进出场作业、其他维护作业的协助和便利，按时接收乙方交付的机械。

5.甲方应当为机械提供安全作业环境，负责机械设备在施工现场的看护，保护设备的安全。如因甲方原因造成机械毁损、灭失的，应向乙方赔偿。

6.甲方应当按操作规程或机械使用规定或合同约定管理和使用机械，不得违章或超负荷作业。由甲方指派的操作人员必须持证上岗。

6.PartyAshallmanageandusethemachineryinaccordancewiththeoperatingrulesortheregulationsontheuseofmachineryorthecontractualagreement,andshallnotoperateinviolationoftherulesoroverload.TheoperatorsassignedbyPartyAshouldbelicensedtowork.

7.未经乙方书面同意，甲方不得转租机械，不得对机械进行改善或增设他物。

1.甲方不履行合同，应向乙方支付违约金元。

2.甲方未按合同约定支付租金的，每逾期一日应按照元/日的标准向乙方支付迟延履行违约金。凡逾期满日的，乙方有权解除合同并要求甲方支付违约金。

乙方违约责任：PartyB'sliabilityforbreach

1.乙方无法提供合同约定的机械或提供的机械型号和规格与合同不符，经甲方书面催告仍不能按时履行或提供的替代机械达不到甲方要求，导致合同无法履行的，甲方有权解除合同并要求乙方支付违约金元。

1.ProvidedthatPartyBisunabletoprovidethemachineryspecifiedhereinorthetypeandspecificationofthemachineryprovidedfailtoconformtothecontract,andstillcannotperformitontimeafterpartyA'swrittendemandorthealternativemachineryprovideddoesnotmeetPartyA'srequirements,whichresultinginfailuretoperformthecontract,PartyAhastherighttoterminatethecontractandrequirePartyBtopayliquidateddamagesofYuanRMB.

2.乙方未按合同约定日期提供机械的，每逾期一日应按照元/日的标准向甲方支付迟延履行违约金。凡逾期满日的，甲方有权解除合同并要求乙方支付违约金。但甲方未预付进出场费或保证金的，无权要求乙方支付逾期交付违约金。

2.WherePartyBfailstoprovidethemachineryonthedatespecifiedherein,itshallpayPartyAliquidateddamagesforeachdayoflateperformanceattherateofYuanRMB/day.Providedthattheoverduedeliveryformorethandays,PartyAhastherighttoterminatethecontractandrequirePartyBtopayliquidateddamages.However,wherePartyAhasnotpaidtheentryandexitfeesorsecuritydepositinadvance,shallnotbeentitledtorequirepaymentoftheliquidateddamagesforoverduepayment.

3.在合同期间因乙方原因（包括乙方指派的操作、维护人员的行为，但乙方按照合同约定对机械进行维修保养的时间除外）导致机械停工的，每停工一天，甲方除扣减相应租金外，可要求乙方支付相当于该机械日租金%的违约金。凡停工超过日的，甲方有权解除合同并向乙方追偿损失。

3.ProvidedthatthemachinerysuspendorshutdownduringthecontractperiodforreasonsattributabletoPartyB(includingtheactionsoftheoperatorsandmaintenancepersonnelassignedbyPartyB,exceptforthetimeforPartyB’smaintenanceonthemachineryasspecifiedherein),PartyAmayrequirePartyBtopayliquidateddamagesequivalentto%ofthedailyrentalofthemachineryforeachdaythemachinery’sshutdown,inadditiontodeductingthecorrespondingrental.Formorethandays,PartyAshallhavetherighttoterminatethecontractandrecoverthelossesfromPartyB.
